Terms of Service

These Terms of Service ("Terms") govern your use of the Kage mobile application (the "App"), operated by Kage ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on Apple-branded devices that you own or control, in accordance with these Terms and Apple's App Store terms. You may not copy, modify, distribute, sell, lease, sublicense, or reverse engineer any part of the App.

3. Your Responsibilities

You are responsible for the accuracy of the information you enter into the App and for all activity that occurs on your device. You agree to use the App only for lawful purposes.

4. Subscriptions and In-App Purchases

• Some features of the App may require a paid subscription or one-time purchase.
• All payments are processed by the Apple App Store. We do not collect or store your payment details.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.
• Refunds are handled by Apple in accordance with the App Store's refund policy.
• We may change pricing for future billing periods with reasonable notice; changes will not apply retroactively.

5. Health and Fitness Disclaimer

Kage is a self-discipline and habit-building tool. It is not a medical, health, or fitness professional service, and nothing in the App constitutes medical advice. Tasks in the App may involve physical activity, changes to sleep schedules, or other lifestyle changes. Consult a qualified professional before starting any new exercise or health routine, and use your own judgment about what is safe for you. You participate in the program at your own risk.

6. User Content

You retain ownership of the information you enter into the App, such as goals, habits, and progress. You grant us a limited license to process this content solely to provide and improve the service.

7. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any law.
• Attempt to gain unauthorized access to the App, its servers, or related systems.
• Introduce viruses, malware, or other harmful code.
• Scrape, harvest, or extract data from the App by automated means.
• Interfere with or disrupt the operation of the App for other users.
• Impersonate any person or misrepresent your affiliation with anyone.

8. Intellectual Property

The App and all of its content — including the name "Kage," logos, designs, artwork, text, quotes collections, program structure, and software — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights in our intellectual property except the limited license in Section 2.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT USE OF THE APP WILL PRODUCE ANY PARTICULAR RESULT OR OUTCOME.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) TEN U.S. DOLLARS ($10).

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Apple App Store Terms

The App is distributed through the Apple App Store, and your use is also subject to Apple's Media Services Terms and Conditions. Apple is not a party to these Terms, has no obligation to provide maintenance or support for the App, and is not responsible for any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Third-Party Services and Links

The App may contain links to or rely on third-party services. We are not responsible for the content, policies, or practices of any third party.

14. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. You may stop using the App at any time by deleting it from your device. Sections 8 through 16 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws applicable in our jurisdiction of operation, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the App will be resolved in the courts of competent jurisdiction, unless applicable law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, for material changes, provide notice through the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
